Discussion and update related to a TCEQ Violation for Failure to Submit Disinfectant Level Quarterly Operating Report (DLQOR).
No action is required at this time.
This item is presented to inform the Town Council of a Texas Commission on Environmental Quality (TCEQ) compliance violation related to the timely submission of a Disinfectant Level Quarterly Operating Report (DLQOR).
The Town of Sunnyvale is required to monitor and report disinfectant residual levels in accordance with applicable Texas Commission on Environmental Quality (TCEQ) public water system requirements. The Town received a compliance violation associated with Failure to Submit a Disinfectant Level Quarterly Operating Report (DLQOR) – Monitoring, Routine (DBP), Major/Chlorine for the first quarter of 2026.
The DLQOR is a required regulatory report used to document and report disinfectant residual monitoring information to TCEQ within the required reporting timeframe. As part of the regulatory response to the violation, the Town is required to provide public notice to all affected stakeholders and customers within the Town of Sunnyvale.
The required public notice will be distributed through utility bill inserts during the next billing cycle, which is anticipated to be distributed at the end of October 2026. Customers who receive their utility bills electronically will receive the notice electronically in accordance with the Town's utility billing notification process.
The required public notice will also be posted on the Town of Sunnyvale's official website to ensure the information is accessible to the public. Such notice will provide information regarding the nature of the violation and the required regulatory information associated with the DLQOR reporting deficiency.
Once the required public notice has been distributed to all stakeholders, the Director of Public Works will complete and submit a Certificate of Delivery of Public Notice Affidavit to TCEQ.
The Certificate of Delivery will document that the Town has completed the required public notification process.
TCEQ will review the Certificate of Delivery of Public Notice Affidavit and supporting documentation and upon their acceptance of the required documentation, the violation will be considered completed and closed by TCEQ.
Staff will maintain copies of the public notice, distribution documentation, Certificate of Delivery of Public Notice Affidavit, and TCEQ correspondence in the Town's regulatory compliance records.
The DLQOR in question has been submitted to TCEQ but because the report was not submitted within the required timeframe, the Town received a reporting violation. The violation remains an open compliance item until the Town completes the required public notification process and provides TCEQ with documentation confirming that the public notice was delivered.
The status of the required report, required public notification, and the corrective actions are being implemented by the Public Works Department.
The required public notification will be distributed through the Town's existing utility billing process and posted on the Town's website.
The cost associated with printing and distributing the required utility bill inserts is approximately $374.00. This expense will be paid from the Utility Billing postage line item 210-1420-52204.
