Discuss and consider making a recommendation to Town Council regarding a waiver from the Town of Sunnyvale’s Unified Development Ordinance (UDO) Section 2. Subdivision Regulations allowing an increase to the maximum length of an existing cul-de-sac street on an approximately 13.5-acre unplatted tract of land described as Tract 34, Abstract 330, Thomas D. Coats Survey, at 629 Pecan Creek Drive, within Single Family Residential-1 (SF-1) zoning district. Case 1886-SDW Anukem Addition.
Staff recommend approval of the subdivision waiver.
The applicant, Andy Igwe, IDD Architecture, has submitted a subdivision waiver to allow an increase to the maximum length of an existing cul-de-sac street, Pecan Creek Drive. Property owner Emily Anukem purchased the unplatted tract from Ms. Debra Franklin and plans to build a single-family home on it. Ms. Anukem received approval from Town Council on a preliminary plat application on September 28, 2024. Based on current UDO restrictions, the preliminary plat was set to expire due to no construction plans and final plat being submitted or approved within 2 years of the preliminary plat approval. Applicant reached out to the Planning Department requesting extension on September 23, 2026, for the Preliminary Plat approval. The Director of Planning and Development Services granted an extension of the preliminary plat approval for 6 months with the deadline to submit the final plat and full engineering plans by October 30, 2026. However, at the request of the applicant, during a pre-application meeting for the final plat application, it was identified that extension and construction of a dead-end cul-de-sac street will be required to provide service to this tract.
UDO Section 2.05.03.G.1 has restrictions related to dead end streets and cul-de-sacs. This UDO requirement was amendment on January 9, 2023, by Ordinance 2022-36. The amendment focused on existing cul-de-sac streets and stated that they shall not be extended to exceed 800 feet in length unless the Planning and Zoning Commission determines that the stipulated criteria have been met.
It is clear from the amending ordinance and the requirements listed in the UDO that the current cul-de-sac street cannot be extended to serve this tract/lot without violating the maximum length restriction. Staff recommended the applicant to request a waiver from Town Council regarding this UDO Subdivision Ordinance regulation to develop the last undeveloped, unplatted tract at this pre-existing dead-end cul-de-sac.
