Discuss, consider, and act upon an Interlocal Agreement with Dallas County Sheriff's Office for the transfer of custody of arrested persons prior to magistration and authorizing the Town Manager to execute the agreement.
Staff recommends approval.
The Interlocal Agreement (ILA) was established by the Dallas County Sheriff’s Office to help ensure that individuals transported to the Dallas County jail have been magistrated by a judge prior to confinement. The associated fee appears to be intended to offset a portion of the costs incurred by the Dallas County Sheriff’s Office in providing magistrate services for these individuals.
After consultation with the Town’s legal counsel, staff recommends executing the ILA prior to the extended November 1, 2026 deadline to maintain it as a contingency option should the judge provided through the Town’s contract with the Mesquite Police Department be unavailable. This agreement would provide an additional option for obtaining timely magistrate services when needed.
Additionally, the Town would maintain the option of utilizing its own judge on an on-call basis to conduct magistrate proceedings prior to transporting individuals to the Dallas County jail. This approach would provide operational flexibility and help avoid the need to rely on magistrate services provided at the Dallas County jail when alternative arrangements are available.
