DEVELOPMENT AGREEMENT AMENDMENT to City of Topeka Contract No. 53457 between Topeka FC 1, LLC, an Indiana Limited Liability Company and the City of Topeka for the Project View RHID.

Voting Requirement: Action requires at least six (6) votes of the Governing Body.

(Approval will authorize the City Manager to execute the contract amendment to remove two parcels of property as legally described as part of the Project View RHID location.)

The Development Agreement between the City of Topeka and Topeka FC 1, LLC must be amended to remove the two parcels of property included in the original agreement. 

The legal description of the Project View RHID contained in Ordinance No. 20635 and Development Agreement Contract No. 53457 incorrectly included two parcels of property. The removal of these two parcels does not constitute a substantial change to the plan for the development of housing and public facilities within the Project View RHID.

In addition to amending Ordinance No. 20635, corrective modifications and related action are required for the Purchase and Sale Agreement and Development Agreement provided for under the Development Agreement.

There is no budgetary impact to the City to approve the contract amendment.
