REQUESTED MOTION

To adopt Resolution No. 26-75, approving the revocation of the rental licenses for the property located at 1064 / 1062 Glenhill Road pursuant to section 30-91 of the municipal code.

 
INTRODUCTION

The city council is being asked to revoke the rental licenses for the property located at 1064 / 1062 Glenhill Road. The council has the authority to suspend, revoke, deny, or not renew a license for any of the reasons listed in Section 30-91. The property owner at 1064 / 1062 is renting out the duplex as each side having two separate units - making it a four-plex. The owner was told that was not an allowable use and that it does not meet code. Staff is recommending revocation and posting the property.

 
DISCUSSION

City regulation(s)
Section 30.91 - License Suspension or Revocation. A dwelling unit rental license is subject to suspension or revocation by the City Council for the reasons specified herein. Prior to suspension or revocation, the Owner or its Agent shall be notified in writing at least five (5) days prior to the City Council’s consideration of such action.

 

Timeline of events: 

The owner of the home called staff and was provided information in 2025 that the duplex did not have the minimum needed requirements to have a quadplex on the property. There are not covered stalls available for all units and accessory apartments are not an allowable use in the R2 District.

  • Rental licenses were pulled for each side individually at the renewal period for the 2026 license.
  • April 21, 2026 - Staff was asked to verify if the property was allowed to operate as a four-plex as part of an appraisal and the appraiser's understanding of the property having separate ADU/Mother In Law units in the basement. 
  • June of 2026, a Zillow listing was found listing the property as "non-conforming" quadplex - including separate mailboxes.
  • June 26, 2026 - The owner of 1064 and 1062 Glenhill Road received a letter from the city informing them that the City was aware of the operation and marketing of the property as an illegal quadplex and that the City will be enforcing the terms of the license and all applicable regulations.

  • On August 6, 2026 a rental inspection was conducted of 1064 and 1062 Glenhill revealing numerous code violations, including the operation of the property as an illegal quadplex with locked doors separating the units.

  • On August 18, 2026, the notice of rental license revocation letter was emailed and mailed to the owner of the property, informing them of the pending city council hearing.

  • Staff requested lease documents and tenant rosters from the owner by 8/25/2026. 
    • Staff was provided with two separate lease documents for each side that were created on 8/22/2026. The creation date of 8/22/2026 is after the dates of the lease terms for both units. The digital signatures had dates before the creation date of the leases and they were not verifiable digital signatures  - including a blurry image with the wrong year. 
    • Staff was provided with tenant rosters that were both created on 8/25/2026 within minutes of each other - not something that was created and submitted to the office as the form directed the tenants to do after filling out. 
  • On August 31st, the Zillow listing still lists the complex as a side by side duplex with "a mother in law suite in the basement". 
  • On September 1st, staff confirmed that there are four mailboxes for the duplex, two with the unit numbers and two with a "1/2" designation after the address. 
 
RECOMMENDATION

Staff is recommending that the city council adopt resolution 26-75 and move forward with the revocation. The approval gives authorization for city personnel take necessary actions to post the property with a placard that they are operating without a rental license. This will allow any tenant to withhold rent, if they choose, until they relocate or the property comes into compliance.
