Ordinance Amendment to Rochester Code of Ordinances Section 8-8-10 Related to the Juvenile Curfew Ordinance
Consent Agenda
The City of Rochester curfew Ordinance Chapter 8-8 expires on December 31, 2026. The ordinance effective date was established to ensure the Common Council will review the ordinance, specifically its effectiveness and need.
The Rochester Police Department (RPD) uses the curfew ordinance as a means to ensure the safety of minors who are out on the streets unsupervised during late night hours. This tool is an important and necessary means to return minors to the safety of their guardians. The curfew ordinance serves to:
1. Protect the public from illegal activity that minors may commit after curfew hours;
2. Protect minors from negative influences and possible gang involvement after curfew hours;
3. Protect minors from criminal activity that occurs after curfew hours; and
4. Assist parents and guardians to control their minor children.
RPD conducted a review of the use of the curfew ordinance and found that over the last two years. During this period, the majority of contacts involved education and curfew warnings being issued. Many parents/guardians were notified, and many minors were returned to the safety of their home. Citations were issued sparingly and judiciously. The ordinance is fulfilling the identified need to ensure the safety of minors. Therefore, RPD recommends the Council continue the ordinance until December 31, 2028, at which time it will be reviewed for renewal.
The curfew ordinance is an effective means to deter minor victimization and delinquency.
The curfew ordinance has been renewed on multiple occasions over the last several decades.
There is no fiscal impact. The continuation of the ordinance enhances the department's ability to protect minors and promote public safety.
No alternate actions are suggested at this time.
