Adopting a Resolution authorizing an annual premises gambling permit for Dodge County Youth Hockey Association, operating out of Smoak BBQ, located at 2291 Commerce Dr NW.

Report Narrative:

Dodge County Youth Hockey Association (DCYHA) is requesting City Council approval of a premises permit to conduct lawful gambling at Smoak BBQ, 2291 Commerce Dr NW.

DCYHA is a nonprofit organization serving children and families in Dodge County and surrounding communities. Its programs provide opportunities to participate in organized youth hockey while developing athletic skills, teamwork, leadership, and sportsmanship.

Minnesota Statutes Chapter 349 governs lawful gambling conducted by eligible nonprofit organizations. Under Section 349.213, subdivision 2, the Minnesota Gambling Control Board may not issue an initial premises permit without approval from the City Council. The organization must submit a Council resolution adopted within 90 days of the date of its application for the new permit. State Statute also does not limit the amount of establishments an eligible gambling entity may operate.

Gambling conducted at this location will be subject to applicable state requirements and the City’s requirements governing lawful purpose expenditures within its designated trade area.

Staff is recommending approval of the attached resolution authorizing DCYHA’s premises permit application.
