Vacation Petition No. CD2026-007VAC, Seneca Foods Addition
Public Hearings
Adopting a Resolution approving Vacation Petition No. CD2026-007VAC, by Seneca Foods Corp., to vacate a 20-foot Public Utility Easement located at 308 20th St SE.
The Applicant and Property Owner, Seneca Foods Corp., has submitted a Vacation Petition to vacate an existing 20-foot-wide Public Utility Easement located within the Seneca Foods property. (308 20 St SE)
The applicant has initiated the process of gaining approvals for an addition to their existing warehouse building located on the subject property. The addition as proposed would be over an existing Public Watermain Utility Easement. To be able to build this extension, the easement must be relocated on site. The proposed new location for the Utility Easement is about 27 feet to the south and will be the same size and allow for the same capacity.
The Applicant has approached Rochester Public Utilities (RPU) for support in the vacation of the existing easement and the replacement in the new location. Upon review of the request, it was confirmed that RPU would have no issues with the vacation provided that the existing water main is reconstructed, relocated via a City/RPU approved construction plan under a City-Owner Contract, and that a new water main utility easement be recorded.
Approval of this request will not adversely impact the public interests or the delivery of any utility service to the subject project or any other property.
The proposed vacation petition achieves the Comprehensive Plan's core principles of Economic Vibrancy & Growth Management and Fiscal Responsibility & Sustainability.
