Action Requested:

Adopting a Resolution approving a contract with Elcor Construction, Inc. in the amount of $3,270,774.55 for the 37th ST NE Stormwater Management Facility – Project No. J6520.

Report Narrative:

A regional stormwater management facility is proposed within the northwest quadrant of 37th St NE and East River Rd NE, immediately south of Foster-Arend Park. This project was last considered in 2018 to implement an online infiltration basin with no stormwater pretreatment. These plans were considered infeasible with respect to current design standards and long-term operation and maintenance. The proposed stormwater management facility was, therefore, revised to include an offline infiltration basin with a large wet sedimentation basin that functions as a pretreatment forebay. This stormwater management facility is intended to provide water quality treatment for the approximate 500-acre watershed that it serves via infiltration, thus reducing the volume of stormwater runoff and sediment conveyed directly to the South Fork Zumbro River. In addition, the project addresses the conveyance of stormwater between the proposed stormwater management facility and the South Fork Zumbro River while maintaining trail connectivity through the parcel.

This project is recommended for construction to fulfill the City’s vision to provide a stormwater water quality banking site in concert with the City’s water quality ordinance. The proposed stormwater management facility will provide stormwater quality treatment credits for approximately 100 acres of impervious surface area. Stormwater water quality treatment credits can be used when stormwater management cannot be facilitated on site of a development project.

Inclusive Growth Management
Policy Considerations & DEI Impact:

The proposed project is consistent with City policies, maintenance requirements, and design standards related to storm water conveyance and water quality treatment.

Prior Legislative Actions & Community Engagement:

August 11, 2025: Council Meeting - Authorization of design services contract

April 6, 2026: Council Meeting – Authorization of contract amendment for design services

May 27, 2026: Study Session - Stormwater Water Quality Treatment Credit Transfer Program

July 20, 2026: Council Meeting – Authorizing the advertisement of bids

Fiscal & Resource Impact:

The 37th St NE Stormwater Management Facility Project - Project No. 6520 is funded through the 2018 Storm Water Capital Improvement Plan (CIP), Map No. 23 Regional Stormwater Infiltration Facility Project: East River Rd/ 37th St NE Infiltration Basin Construction. The original CIP budget for this project was $1,410,000 but as previously noted, was determined to be infeasible. The additional funding required will be covered by Storm Water Utility Fund reserves. Dependent on the final outcome of Stormwater Water Quality Treatment Credit Transfer Policy, this project would be eligible for recouping a portion of the project cost through the sale of stormwater water quality credits.
