Report Narrative:

At the July 20, 2026 Council meeting, the Council authorized a City-Owner contract and a Professional Technical Services contract for Project No. J5641, "Public Improvements to Serve London Brook Ponds (Phase 1)", as item F-10, subject to certain conditions being met prior to execution by the City. The contracts authorized on July 20th have not been executed by the City, and the development team has requested to change the Contractor. This requested revision is material to the contract terms and necessitates the need for Council authorization of the updated contracts. Public Works brings forward an updated City-Owner and a professional technical services contract for consideration by the Council for Project No. J5641, "Public Improvements to Serve London Brook Ponds (Phase 1)." A City-Owner contract is recommended with London Brook Ponds Academy Group LLC, (as Owner), Fitzgerald Excavating & Trucking Incorporated, (as Contractor), and GGG, Inc., dba G-Cubed, (as Design Engineer). The use of a City-Owner contract will accommodate Owner's timeline for development while ensuring that the quality of public infrastructure meets City Standards, and it is the preferred contract to utilize for this project. A professional technical services contract is recommended with GGG, Inc., dba G-Cubed, (as Consulting Engineer) for $45,675, to be paid by Owner. It is required by the City-Owner contract that Owner provide professional technical services for the project, as defined in the City Specifications and Standards.

Priorities & Foundational Principles:
Housing Access
Fiscal Responsibility and Sustainability
Policy Considerations & DEI Impact:

A City-Owner contract is a required part of the City-Owner Construction Program, which is designed to ensure that the installation of public infrastructure, within a private development or due to a private development, is constructed to City Standards.
