On April 21, 2026, the San Bernardino County Board of Supervisors established the San Bernardino Water and Power Authority (“Authority”) through execution of a Joint Powers Agreement with Fenner Gap Mutual Water Company. The purpose of the Authority is to assist and support local agencies in accessing public financing and grant resources for water and energy infrastructure projects throughout the County.
The Joint Powers Agreement allows for additional public agencies to join the Authority subject to approval of associated terms and conditions by a majority of the Authority’s Board of Directors. The option for additional public agencies to participate in the Authority provides an opportunity for regional collaboration toward the Authority’s goals.
On July 15, 2026, the Board approved Resolution No. 2026-7-3 expressing intent to participate as a member of the Authority, subject to the approval of the Authority Board of Directors. The Board also authorized the General Manager to conduct all negotiations required to finalize the terms and conditions of participation.
The Authority has now approved IEUA’s entry and participation as a member.
Staff recommends that the Board:
- Approve the Joint Exercise of Powers Agreement creating the San Bernardino Water & Power Authority and IEUA’s entry therein; and
- Authorize the General Manager to execute the Joint Exercise of Powers Agreement, subject to non-substantive changes.
There is no financial impact to the Agency at this time. Future participation in specific projects or financial commitments will be voluntary and subject to IEUA Board approval.
