Title:

Amendment to the charter commission bylaws

Report from:

Erik Nilsson, City Attorney

Action Requested:

Motion to adopt the amendment.

Summary Statement

Proposed amendment of Article 4, Section 4, of the bylaws regarding "Number of Members" to reflect the charter amendment adopted by the city council on January 12, 2026.

Background

At its annual meeting on November 18, 2025, the charter commission voted to recommend that the city council adopt an ordinance approving the amendment of the charter to establish a fixed commission membership number pursuant to Minn. Stat. Sec. 410.05, subd. 1. On January 12, 2026, the city council voted unanimously to adopt a new section 2.12 of the city charter to establish a fixed membership composition of nine members with the ability to expand by one member to 10 total based on the appointment of a sitting council member. This new charter provision became effective 90 days after publication of the council action. On June 17, 2026, Mayor Rebecca Schack was appointed by the chief judge as the 10th member of the commission.

Staff is now following up with the corresponding amendment of the provision in the bylaws that addresses the size of the commission.
