1. Approve the Final Map for Fairview Corners TSM 17-103, Tract No. 352 Phase 2, consisting of seventeen (17) residential lots; and
2. Accept on behalf of the public the offers of dedication for public uses in conformity with the terms of the offers of dedication, subject to improvement and subject to the condition that the County of San Benito is not responsible or liable for any cost or expense associated with an offer accepted unless authorized by separate action of the Board of Supervisors; and
3. Direct the Clerk of the Board to certify on the Final Map the action of the Board of Supervisors; and
4. Authorize staff to submit the Final Map to the San Benito County Recorder's Office for recordation after the County Engineer determines that all applicable documents, security, and conditions precedent to recordation have been satisfied.

In November 2012, the Board of Supervisors adopted the Fairview Corners Specific Plan, which allows development of a residential project consisting of up to one hundred eighty-nine (189) residential units. The Planning Commission subsequently conditionally approved Tentative Subdivision Map TSM 17-103, commonly known as Fairview Corners, on July 18, 2018. Due to the scale of the project, the subdivision is being developed in multiple phases.
On August 27, 2024, the Board approved the Final Map for Phase 1, consisting of seventy-four (74) lots. The developer is now seeking approval to record the Final Map for Phase 2, which consists of seventeen (17) residential lots. With approval of the Final Map for Phase 2, the total lot count being created and recorded is 91 lots.
Section 23.09.008 of the San Benito County Code requires a Final Map to be submitted to the Board of Supervisors for approval after the County Engineer confirms that it conforms to the approved or conditionally approved Tentative Map. The County Engineer and the Director of Planning have confirmed that the Phase 2 Final Map complies with the approved Tentative Map and applicable conditions of approval, as reflected in the Development Agreement. Following Board approval and satisfaction of all applicable recordation requirements, the Final Map will be submitted to the San Benito County Recorder's Office for recordation.
On June 23, 2026, the Board directed staff to work with the developer to provide for ongoing maintenance of the landscaped median along Fairview Road through Community Facilities District No. 2018-01. In a written commitment dated August 11, 2026, Fairview Corners, LLC confirmed that Phases 2 and 3 will be annexed into CFD No. 2018-01, Tax Zone 13A, and that the district boundaries will be expanded to include the median. The CFD will fund eligible costs associated with the maintenance, repair, replacement, and operation of the median landscaping and related improvements.
Approval and recordation of the Phase 2 Final Map will have no impact on the County General Fund. The developer is responsible for applicable map processing, recordation, subdivision improvement, and security costs. Following annexation, eligible ongoing maintenance costs for Phase 2 and the Fairview Road median will be funded through CFD No. 2018-01, Tax Zone 13A.
