AGENDA SECTION:

CONSENT AGENDA

BACKGROUND/SUMMARY:

On November 5, 2024, California voters overwhelmingly approved Proposition 36. The statutory intent of this framework is to create a treatment-focused court process. Individuals charged under this statute are offered the opportunity to complete court-ordered drug and mental health treatment. Successful
completion of the treatment program results in the dismissal of the charges, prioritizing a health-based resolution over incarceration for eligible participants. While Proposition 36 established these new legal mandates, it did not originally include a dedicated funding source.

The California State Legislature included a one-time allocation. This funding, authorized under Prop 36, is intended to support County Behavioral Health Departments in establishing the necessary infrastructure to conduct assessments, coordinate with the courts, and deliver the mandated treatment services. San Benito County's non-competitive one-time allocation is $298,226.72.

On February 10, 2026, the Behavioral Health Department received permission from the County Board of Supervisors and the County Executive Officer to apply for the funding and to respond to the Request for Information (RFI) from the California Department of Health Care Services (DHCS) and The Center at Sierra Health Foundation. The Sierra Health Foundation Center for Health Program Management is the administrative entity for DHCS.

The Center at Sierra Health Foundation, on behalf of the California Department of Health Care Services (DHCS), will begin executing Standard Agreements as submissions are received. The term of the grant will be March 1, 2026, through March 31, 2028, per the Subrecipient Agreement.

FISCAL IMPACT:

The grant funding received will help the Behavioral Health Departments in establishing the necessary infrastructure to conduct assessments, coordinate with the courts, and deliver the mandated treatment services under Proposition 36.

San Benito County Behavioral Health recognizes that the grant funding of $298,226.72 is a one-time allocation, and will work on utilizing other funding sources such as Medi-Cal, Realignment subaccounts, and other available funding to ensure ongoing funding for this mandate.

This funding will be allocated to GL # 228.90.2520.1000.550.401.
