2. Authorize Chair, County Executive Officer, or designee to sign the contract.

CONSENT AGENDA
The original contract was executed April 16, 2019 with EMC Planning Group Inc. for an amount not to exceed $292,435.00, for the Ridgemark project and associated environmental review under the California Environmental Quality Act (CEQA), County Planning File PLN170008. The original contract provided for preparation of the environmental documentation necessary to evaluate the proposed Ridgemark project, including preparation of the Notice of Preparation, Administrative Draft EIR, Proof Draft EIR, Draft EIR, Administrative Final EIR, Final EIR, Mitigation Monitoring Program, CEQA Findings, and Notice of Determination. The original contract was initially scheduled to expire June 30, 2020 and has subsequently been extended through a series of amendments. The contract and all prior amendments are incorporated into Amendment #8.
The anticipated County entitlements identified in Amendment #8 include:
- Rezone—Add the Planned Unit Development (PUD) Combining District to implement the new Master Plan.
- Affordable Housing Plan—Adoption of an Affordable Housing Plan.
- Parks & Open Space Master Plan—Adoption of a Parks & Open Space Master Plan.
- Vesting Tentative Subdivision Map—For up to 160 single-family residential lots and 15 affordable lots, with a maximum of 30 duets/duplexes, as well as commercial lots, infrastructure, and open space.
- Conditional Use Permits—For commercial development.
The environmental review and entitlement process has required additional work over the course of the project due to changes in the project description and additional CEQA requirements. Previous amendments added environmental analysis and related work, including revisions to the EIR, additional biological field work and research, AB 52 Tribal Consultation-related work, preparation of a Draft EIR, transportation/VMT analysis, and updates related to the project description and surrounding development. Amendment #8 now provides for the additional work necessary to prepare the final project documents required to complete the entitlement process.
Under Amendment #8, EMC Planning Group Inc. will provide planning support to the County for completion of the project process. The additional services include project administration and coordination; review of project materials and the draft EIR; preparation of public hearing notices, staff reports, ordinances and resolutions; coordination of interagency and interdepartmental review; incorporation of mitigation measures into approval documents; and preparation for and attendance at the Planning Commission hearing and Board of Supervisors hearing.
The contract is being amended to extend the term from the current expiration date of June 30, 2026, to September 30, 2027, and to provide an additional $72,845.75 for the additional services.
Original Contract: $292,435.00, executed April 16, 2019.
1st Amendment: $0.00 – Extended the contract term from June 30, 2020, to June 30, 2021, with no change to the scope or compensation.
2nd Amendment: $47,045.00 – Added additional environmental services, including biological mitigation work, VMT analysis, mobile-source air quality, greenhouse gas emissions and energy analysis, and related project-description and biological-resource work.
3rd Amendment: $72,829.50 – Added work associated with changes to the project description, including additional affordable housing units, a new Southside Road access intersection, clarification of commercial uses, and associated transportation and noise analysis.
4th Amendment: $11,550.00 – Added transportation consulting services and updates to the transportation analysis consistent with the CEQA Vehicle Miles Traveled methodology.
5th Amendment: $0.00 – Extended the contract term from December 31, 2022, to June 30, 2023, with no additional compensation.
6th Amendment: $50,604.00 – Added additional EIR work, including revisions resulting from changes to the project description, preparation of a Proof Draft EIR, additional biological survey and research, AB 52 Tribal Consultation-related work, and updates concerning the Rancho Santana School. The amendment increased the contract to $474,463.50.
7th Amendment: $0.00 – Extended the contract term from June 30, 2024, to June 30, 2026, with no modification to the scope of services or payment terms.
8th Amendment: $72,845.75 – Adds the additional planning and entitlement-processing services necessary to prepare the final project documents and complete the entitlement process, and extends the contract term from June 30, 2026, through September 30, 2027. The amendment increases the total contract amount from $474,463.50 to $547,309.25.
Total Contract Amount after Amendment #8: $547,309.25.
The amendment is in the amount of $72,845.75 for a total contract of $547,309.25 to be paid by permit applicant. The contract amendment would also extend the term of the contract from the current expiration date of June 30, 2026 to a new expiration date of September 30, 2027. This contract will be paid out of Non-general fund, SBC Budget Line Item Number 639.70.7595.1000.619.222.
