1. Adopt Resolution approving a side letter agreement to the 2025-2026 collective bargaining agreement between the County of San Benito and the Deputy Sheriffs Association; and
2. Authorize the County Executive Officer, or their designee, to take all necessary administrative actions to implement and execute the provisions outlined in the Side Letter, including any related documents, agreements, and other actions necessary to carry out its terms.

CONSENT AGENDA
On April14, 2026, the Board of Supervisors approved a Memorandum of Understanding (MOU) between the County and Deputy Sheriffs Association (DSA). The DSA is comprised of Sheriff’s Deputies, Sheriff’s Sergeant, Deputy Probation Officers, Supervising Deputy Probation Officer, District Attorney Investigator I, II, and District Attorney Investigator I, II Welfare Fund.
On June 30, 2026, in a Special Meeting, the Board of Supervisors approved proposing additional terms to modify the MOU. The DSA and The County engaged in a meet and confer and have reached a tentative agreement on the Board of Supervisors’ approved proposal. DSA membership ratified this tentative agreement on August 5, 2026.
This ratified tentative agreement to modify the MOU by Sideletter; this is now before the Board for approval.
Summary of the modifications include, for Sherrif’s Deputy and Sheriff’s Sergeants only:
- Allow prior law enforcement public service to count for longevity eligibility calculations.
- Add 5% Night Shift Differential for hours worked between 6:00pm and 6:00 am.
- County increased contribution to fully pay for health premiums for 2026 and 2027 for status quo plans or up to PORAC plan premiums if employee changes plans.
- Incentive bonus for new hires ($25K in 5 annual installments).
There is no additional fiscal impact. On June 30, 2026, the Board tentatively approved the FY 2026-2027 CEO recommended budget, including total appropriations. This included unfunding four (4) Sheriff's Deputy positions and one (1) Sheriff's Lieutenant to cover the cost.
