CONSENT AGENDA
Government Code Section 87306.5 requires the Board of Supervisors, as the Code Reviewing Body, to conduct a biennial review of the Conflict of Interest Code for county employees, departments, boards, commissions, and agencies. Before July 1 of each even-numbered year, the Board must direct that the review be undertaken. By October 1, the Board must either: (1) determine that no amendments to the Code are necessary; or (2) determine that amendments are required and order that revised codes be submitted for adoption within 90 days.
On June 23, 2026, the Board of Supervisors directed the County Clerk, in collaboration with County Counsel and the Clerk of the Board, to coordinate the 2026 biennial review of the Conflict of Interest Code.
Following that direction, notices and reminders were sent to all county departments, boards, commissions, and agencies requesting that each review its current list of designated positions and submit any necessary revisions. Each department reviewed its list, determined whether the duties of each position still warrant designation, and submitted revisions. The County Clerk and County Counsel have compiled and reviewed the departments' responses.
The attached amended Conflict of Interest Code reflects the revisions submitted by the departments. Several departments identified positions that have been added, removed, or reclassified since the last biennial review. A "Tracked Status" document reflecting the recommended changes to the prior code by department with related reasons for the changes indicated accordingly, is also attached.
It is now recommended that the Board determine that amendments are required, approve the amended Conflict of Interest Code, adopt the resolution, and authorize the Chair to sign the resolution updating the Code, in compliance with Government Code Section 87306.5.
The review was conducted by existing staff within the existing platform and did not have any additional General Fund impact.
