PLN-26-0044 - Extension of Time (EOT) No. 3 for TTM 33840
That the Wildomar Planning Commission take the following actions:
1. Determine that no additional environmental review is required per CEQA Guidelines Section 15162; and
2. Adopt a PC Resolution No.2026-16, entitled
PC RESOLUTION NO.2026-16
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF WILDOMAR, CALIFORNIA APPROVING PLN 26-0044, A ONE (1) YEAR EXTENSION OF TIME (EOT NO. 3 OF 3) THROUGH SEPTEMBER 23, 2027, FOR TTM 33840, LOCATED AT THE TERMINUS OF ELM STREET BETWEEN GRUWELL STREET AND WILDOMAR TRAIL (APN: 376-043-027), AND DETEMINATION THAT ADDITIONAL ENVIRONMENTAL REVIEW IS NOT REQUIRED PER CEQA GUIDELINES 15162.
The Planning Commission reviewed Tentative Tract Map 33840 (PA 08-0154) on September 23, 2015, and approved the proposed project for the subdivision of 4.07 acres into 15 lots for future single family residential development.
The Planning Commission approved the first EOT on October 3, 2018, extending the expiration to September 23, 2021. The California State Assembly passed AB 1561 in 2021 which provided an automatic 18 month extension to qualifying projects. This extended the expiration date to March 23, 2023. The Planning Commission approved the second EOT on April 5, 2023, extending the expiration to March 23, 2025. In 2024, the California State Assembly passed AB 2729 which provided an automatic 18-month extension to qualifying projects. This extended the expiration date to September 23, 2026. Since the applicant has not recorded the final map on the approved development project, they have requested a final 1-year extension of time ("EOT") that will give them, if approved, through September 23, 2027, to record the map.
The applicant filed the EOT application and paid the required fee on September 9, 2026, as required. Based on the timely submittal, staff has determined that the approved Tentative Tract Map remains consistent with the originally approved project, and remains consistent with the General Plan and applicable development standards. Additionally, the project setting and local circumstances have not changed in such a manner as to render the previously approved project incompatible with the surrounding area. Thus, staff further determines that the approved project meets all of the required findings for approval of an EOT.
The Planning Division has evaluated the criteria for California Environmental Quality Act (“CEQA”) Guideline 15162 and determined that there have been no significant changes in the project, no significant changes in the circumstances under which the project will be undertaken, and no new information has come to light regarding new or significant environmental effects. Therefore, no further environmental action is required by the Planning Commission for this EOT request.
In accordance with Section 17.125.070 of the Wildomar Municipal Code, the Planning Division on or before October 25, 2026, mailed a public notice to all adjacent property owners within a 600-foot radius of the project site notifying them of the November 4, 2026 Planning Commission meeting and the request under this agenda item.
