Background and Analysis:
Roger Sayles (Requestor) owns property located north of the subject city owned property (APN: 330-31-001) identified in Exhibit 1. The City owned property is 635 acres in area and is situated west of the city boundary and south of the requestors property. Due to topographical constraints and based on historic use the only viable access is a circuitous route that currently bisects the city owned 635 acre parcel from east to west before turning northward towards Mr. Sayles property.
The easement (Exhibit A) as shown is approximately 1,469 feet in length and represents approximately 1.349 acres of the 635 acre parcel. There are currently no development plans or other identified use of the 635 acre parcel, and the proposed easement would not unjustly encumber the city owned land. Should the 635 acre property ever be sold, the easement would convey with the land and should it ever develop, an established roadway network would then provide access at which time the easement would be extinguished.
An fair market appraisal (Exhibit B) was performed to assess the value of the land for the purposes of ingress and egress and has establish a value of $352.57. Based on the appraised value, Mr. Sayles is hereby seeking approval of the easement and payment of the appraised value of $352.57.
Based on the current use of the property and appraised value staff has no concerns with the granting of the requested easement.
If approved, the General Fund would receive one time revenues in the amount of $352.57.
Approve Resolution No. 5645
Mayor and City Council Approve Resolution No. 5645 thereby granting the ingress and egress easement.
