The current City Street Regulations say that Common Council may require street lights to be installed by the developer as a condition to approval of specific developments. Thus, whether or not street lights are required to be installed as part of a new subdivision is currently a Council Decision. Recent legislative changes have made final plat approvals an administrative function, so that City Council is no longer part of the final plat approval process. Given this change, it is recommended that the requirements for street lighting as part of development projects be stated explicitly in the City Street Regulations, which would allow staff to determine when street lights are required.
This ordinance will make street lights required for new developments that abut arterial streets, as well as at signalized intersections, roundabouts, and on collector streets when required by the City Engineer based on an approved traffic study, roadway design or documented safety need.
Additionally, this ordinance will update the City's street lighting design standards.
Upon construction and installation, there would be an increased fiscal impact to the Highway Users Revenue Fund associated with the cost of power and ongoing maintenance of the new street lights.
