CONSIDERATION OF AND ACTION ON
Resolution R2026-50 Authorizing the Fee Simple Acquisition of a 37.030-Acre Tract of Land Along Tres Palacios Creek for Purposes of Use as a Detention Pond in Conjunction with the City of El Campo's Channel Improvements, Drainage Enhancements, Erosion Control, and Flood Mitigation Purposes to Reduce Health and Safety Concerns; Authorizing the City Manager or Designee to Negotiate for the Acquisition of Said Fee Simple Interest; Authorizing Acquisition by Eminent Domain if Necessary; and Providing an Effective Date
The Tres Palacios Creek Phase II Project funded by the Community Development Block Grant Mitigation (CDBG-MIT) Program (through the Texas General Land Office) is in the process of completing acquisitions for this drainage project. Despite good faith efforts to negotiate acquisitions for this project, City staff and Property Acquisition Services (PAS) have nevertheless been unsuccessful executing a fee simple agreement for the 37.030-acre tract of land necessary for the Detention Pond component of the project. City staff procured Ross, Molina, Oliveros, P.C (RMOPC) to begin the process of acquiring the necessary property interests through eminent domain where necessary.
Staff recommends adoption of Resolution R2026-50 declaring a public necessity for the required detention pond and initiating eminent domain process where necessary.
