Public Hearing on Resolution 2026-21 - Resolution of Necessity on Orleans Ave Project

All properties have been sent a notice of public hearing, the Resolution and their assessment amount prior to the public hearing as required by the State statute. The City Council will hold the public hearing, take any feedback from the affected property owners and proceed with the adoption of the Resolution No. 2026-21 the Resolution of Necessity for the Orleans Ave project.

Attached is Resolution No. 2026-21: The Resolution of Necessity to implement the Special Assessment process for the completion of the proposed Orleans Ave project. This meeting is to consider the adoption of the Resolution of Necessity for the purpose of implementing a special assessment for the Orleans Ave project. The scope of the area of the project is reflected on the attached map. The City has expressed an intent to assess a portion of the project towards the benefitting properties that abut the project. The City has communicated this intent with the property owners by sending cost 
estimates and holding a public meeting with the owners.

The City will now take the necessary legal steps to implement the special assessment process. The resolution of necessity is intended to describe the necessity to complete a project by creating a description of the area the City plans to assess, outlining legal descriptions for these areas affected and specifying the method of assessment the City will implement for this proposed Project. Attorney Hammer has reviewed the Resolution of Necessity for the project. The City is planning to assess the project based on the adopted Special Assessment Policy. The Council has determined that the City will assess on a per lineal foot basis on those properties that will benefit from the proposed infrastructure improvements. The City is proposing a $80 per lineal foot assessment on properties affected by the project. The total cost of the project is estimated at $4,900,000. The current estimate for assessments on this project is $250,320 a very small percentage (about 5%) of the total project costs. A total of 36 properties will be affected by the project. It is necessary to approve this Resolution prior to the start of the bid process.  

This is a public hearing and council must take comments from any affected property owners that wish to speak and then approve Resolution 2026-21 as presented.
