Agenda Request

Item # 12.14

SUBJECT:

Updates to Soil Erosion and Sedimentation Control Ordinance.

MEETING DATE:
October 20, 2026

SUBMITTED BY:
Staff Attorney
SUGGESTED ACTION:

Consider ordinance amendment updating Chapter 26 of the Code of Ordinances - Soil Erosion and Sedimentation Control Ordinance.

FACTS AND ISSUES:

Cherokee County is strengthening its soil erosion rules by adding misdemeanor penalties for serious or repeated violations. Offenders may face fines, short jail time, or both, with each day of noncompliance treated as a separate offense. These criminal penalties supplement the civil and administrative enforcement tools the County already uses.

The proposed amendment incorporates clarifications and refinements based on feedback and discussion during the public hearing held on September 15, 2026.
