SUGGESTED ACTION
"The Chanhassen Planning Commission, acting as the Board of Appeals and Adjustments, approves the request for a front yard setback variance for the property located at 6871 Nez Perce Drive." |
The Applicant is requesting a variance to the required front setback to facilitate the construction of a deck on the existing lawful non-conforming home located at 6871 Nez Perce Drive.
This property is located in the Carver Beach neighborhood, platted in 1927. The home was constructed in 1930 according to Carver County data. Based on historical imagery, Ponderosa Drive was constructed after the home; however, an exact year cannot be confirmed.
This property contains a single-family home, front deck, garage and driveway. Currently, the rear of the home has a stoop leading from the house to the backyard. The house is set back 18 feet from the southeast corner to the right-of-way; the current city code minimum requirement is a 30 foot setback, but allows for an encroachment of 5 feet for open decks. This home is considered lawful nonconforming for the front setback along Ponderosa Drive. The current property owner did not own the home at the time of construction and now faces challenges when constructing a deck, a reasonable and typical request for a home. The proposed location of the deck is also the most reasonable location based on interior layout of the home.
Staff recommends that the Chanhassen Planning Commission approves the requested front yard setback variance to construct the deck as demonstrated in the plan set.
