SUMMARY

The city is implementing a project to rehabilitate Bluff Creek Drive between Hwy 212 and CSAH 61 (Flying Cloud Drive).

The MN River Bluffs Regional Trail, which is owned and operated by Carver County, intersects Bluff Creek Drive. Improvements to the trailhead, trail, and street crossing are planned by Carver County in the near future, and the opportunity of the city's street project is being leveraged to implement the two projects together. As such, a Joint Powers Agreement (JPA) is needed to outline responsibilities of both parties. The city will lead the project, pending applicable approvals by the County for the trail scope, and the County will reimburse the city for all costs associated with the trail scope. Similar JPA's have been used between the city and county on many other past projects. The County Board has already approved the JPA.

BACKGROUND

DISCUSSION

The City's Bluff Creek Drive street project has a scheduled Improvement Hearing and action of considering ordering the project on tonight's City Council agenda. If ordered by the Council, the project will move into final design, and the County trail improvements will need to be added to the scope of services for the consultant. As such, an amendment for those services is also being asked of the City Council in concert with the JPA, since the city is the contracting authority for the design consultant.

BUDGET

N/A - Costs for the street project are covered by the City and costs for the Trail are covered by the County.

RECOMMENDATION

The City Attorney has reviewed the JPA, and staff recommends approval of the JPA and the design amendment.
