I move to adopt, on second reading, Bill No. 109, Ordinance No. 2026-12.
August 20, 2026 (Item 18.a) – The Board of Supervisors ("Board") introduced, on first reading, the proposed ordinance as Bill No. 109, which passed on a vote of 4-1.
August 2, 2012 (Item 21) – The Board adopted, on second reading, a proposed ordinance amending CCMC to create a new chapter on Financial Administration and creating a new section, Carson City Municipal Code (“CCMC”) 2.44.010 (Majority voting required on use of public funding for Carson City Center Project).
July 19, 2012 (Item 21) – The Board introduced, on first reading, a proposed ordinance amending CCMC to create a new chapter on Financial Administration and creating a new section, CCMC 2.44.010 (Majority voting required on use of public funding for Carson City Center Project).
In 2011 and 2012, the Board held discussions during public meetings about a proposal for a development project in the downtown area, referred to as the “Carson City Center Project” and also known as the “Nugget Economic Development Project” or the “Nugget Project,” to consist of a Knowledge and Discovery Library, a central outdoor plaza, parking structure, retail space and other public improvements and infrastructure. Members of the community who were opposed to the proposed development project filed a sample initiative petition ordinance with the Clerk-Recorder’s Office after obtaining a sufficient number of signatures pursuant to the initiative petition process under NRS chapter 295. As a result, the initiative petition ordinance could be adopted by the Board as a City ordinance without any change in substance to the proposed language of the ordinance or the Board could reject the ordinance. If rejected by the Board, the Board would have been required to submit the initiative petition ordinance to the voters as a ballot question during the November 2012 general election or commence a court action to prevent the question from being placed on a ballot.
The District Attorney’s Office in 2012 advised the Board that the initiative petition ordinance language, as submitted, was likely unlawful because it sought to supersede the spending power of the Board as granted by the City Charter and state statutory provisions. The current District Attorney’s Office agrees with that position. The Board, however, elected to adopt the ordinance in 2012.
To fund the development project, the City submitted a ballot question to authorize a 1/4 of 1 percent sales tax increase. However, that ballot question failed during the 2012 general election.
CCMC 2.44.010 is now proposed to be repealed as part of the City’s ongoing CCMC revision project. The original Carson City Center Project is obsolete and the language of the provision is likely unlawful and therefore void and unenforceable as a restraint on the power of the Board. This proposed ordinance, if adopted, would repeal CCMC 2.44.010.
