ITEM TITLE:

Deliberation and possible action related to professional engineering services to be provided by WSB, LLC (Assistant City Manager Wendy L. Smith, Assistant City Manager Lindsey Baker, and WSB Representatives) [PUBLIC TESTIMONY]

1A. Possible action to authorize the City Manager to execute agreement with WSB, LLC for Buda Championship Park Construction Phase I Administration and Management Services in an amount not-to-exceed $144,644.

1B. Possible action to authorize the City Manager to execute Amendment No. 1 to Contract 26-252 for Staff Augmentation Services, reducing the total not-to-exceed from $160,000 to $135,000.

1. EXECUTIVE SUMMARY

This item would authorize a contract with WSB to provide construction management and administration services through December 31, 2026, for the Buda Championship Park project and would authorize an amendment to the staff augmentation agreement to lower the not-to-exceed amount that was approved by City Council on September 15, 2026, in support of other City of Buda capital projects.

2. BACKGROUND/HISTORY

On September 15, 2026, City Council authorized the City Manager to execute a Professional Services Agreement with WSB, LLC for an amount of $160,000 for staff augmentation services to supplement staff in managing CIP projects. WSB is selected from the current 2024 approved GEC list approved by the City Council through Resolution #2024-R-48. Since the PSA was approved by City Council on Sept. 15, it has been determined that the City requires full construction administration and management services to complete the construction of Buda Championship Park, not just project management support.

City Council took no action on the agenda item to execute Amendment No. 2 to Contract #25-018-A with DCS on October 7, 2026. The City understands that DCS's position remains that construction administration and construction management services related to Buda Championship Park have been contractually fulfilled as of August 31, 2026. In order to facilitate the completion of the BCP construction project, City Council directed staff to bring forward a proposal from WSB for Owner's Representative Services through December 31, 2026, to include project management and services management, construction phase services, and close out services.

3. ANALYSIS

Contract Amendment 1A will provide the necessary staffing to manage, oversee, and administer the remainder of Phase I construction for Buda Championship Park.

Contract Amendment 1B reduces the CIP Staff Augmentation Services to $135,000. WSB is being utilized to support the Capital Projects program while staff is reduced (Capital Program Manager on leave, vacant CIP Project Manager, and the Engineering Coordinator assumes new duties in support of the Capital Project team). The CIP program contains 52 active CIP projects.  Examples of the projects/tasks in need of support include: PW/Parks Facility Expansion technical review; East Main Street CAMPO grant technical assistance; Stagecoach House initial coordination (if approved on 10/20); various sidewalk projects; pay application tracking and calculations for all projects in construction; and contract management.

4. FINANCIAL IMPACT

1A: The original contract with DCS included a lump sum amount of $274,000 for construction phase services. Construction is now anticipated through December 2026 and requires four additional months of continued supportive services. DCS requested an additional $150,400 for continued services and stopped responding to RFIs and other construction management and administration tasks in early September 2026, claiming they had fulfilled their contractual obligations for construction administrative and management services as of August 31, 2026. As a result, WSB provided these services from September to-date.

The amendment with WSB for construction phase services through December 31, 2026, is a time and materials not-to-exceed of $144,644. The utilization will depend on the number of RFIs and project closeout documentation. The funding for this service will come from the Buda Championship Park project fund: 855-4611.56117.12404.

1B: If amended, the contract amount for Staff Augmentation Services would be reduced to $135,000. To-date, WSB has rendered $20,000 in services for BCP and CIP projects, including the Public Works and Parks Facility, leaving a remaining contract amount of $115,000 for FY27. This contract/amendment is not for 2021 GO Bond related project support. Staff augmentation is budgeted to account 100-4805.54004.

5. STRATEGIC PLAN/GOALS
FUN EXPERIENCES FOR ALL

6. STRATEGIC PLAN OBJECTIVES
Activate and expand Sportsplex, including sports field for recreation and tournament

7. PROS AND CONS

Pros:

  • WSB has a proven track record of working through project completion on other bond projects and has a clear approach lined out in their proposal.
  • WSB has demonstrated they work collaboratively and efficiently with the contractor.

Cons:

  • Requires expenditure of City funds for contracted professional services.
  • May reduce continuity of services, but City staff will work diligently with WSB and DCS to ensure continuity through the completion of the project.

8. ALTERNATIVES

If the amendment is denied, the City may experience delays in project delivery, program reporting, coordination, and schedules, potentially resulting in resource constraints, schedule delays, and increased uncertainty for the successful completion of Buda Championship Park.

9. REQUESTED ACTION / SUGGESTED MOTION / RECOMMENDATION
Staff recommends approval of an amendment to the WSB Contract for Buda Championship Park Construction Phase I Administration and Management Services in an amount not-to-exceed $144,644. Additionally, staff recommends authorizing the City Manager to execute Amendment No. 1 to Contract 26-252 for Staff Augmentation Services, reducing the total not-to-exceed from $160,000 to $135,000.
