ITEM TITLE:

Deliberation and possible action to authorize the City Manager to execute deductive Change Order #5 totaling ($91,514.05) with G Hyatt Construction, Inc. related to the Buda Championship Park construction (City Manager Micah Grau and Assistant City Manager Lindsey Baker) [PUBLIC TESTIMONY]

1. EXECUTIVE SUMMARY

Approval of this item would authorize the City Manager to execute a deductive change order with G Hyatt Construction. The change order will reduce the overall construction price by $91,514.05 and add 80 days to the construction schedule, changing final completion to December 4, 2026.

2. BACKGROUND/HISTORY

The City Council awarded a construction contract to G Hyatt Construction in August 2025 for the renovation of Buda Championship Park. While this is labeled as Change Order #5, it is actually the 7th change order as two others have been negotiated while this was pending. Change Order 5 was originally proposed as a deductive change order for electrical work that was outsourced to a different contractor. While that is still included, Change Order 5 also includes various other clean up items. It also adds a negotiated 80 days to the construction timeline that are associated with rain out days and for delays while awaiting design clarifications through requests for information (RFIs). This change order also relieves the contractor of previously assessed liquidated damages after the interim substantial completion for the softball fields was missed in July.

3. ANALYSIS
Item # Description Amount
1 Deduct ice maker. ($13,464.15)
2 Batting cage additions. The plans omitted breakers, fan controller enclosures, and conduit for the installed fans. $11,788.51

5 Additional Rip-Rap needed at Water Quality Pond. $19,927.68
6 Additional 80 days for final completion and 57 days of contractor's extended general conditions $70,889.19
7 City waiver of previously assessed liquidated damages. $0
8 Electrical deletion for items left in plans for future north concessions stand. ($70,450.38)

12 Grading corrections around electrical equipment. $7,380.52

  Total ($91,514.05)

Please note that line item 3 is a deduct for the removal of decomposed granite. However, the City is negotiating a contract with a different vendor to add back decomposed granite at an additional quantity. The overall cost of the decomposed granite will increase, but the cost per unit will decrease.

4. FINANCIAL IMPACT

This change order will reduce the contract with G Hyatt Construction, Inc. by $91,514.05, but it will not reduce the overall project costs by this much as some of the items will still be purchased by the City or installed by different contractors. The City has also purchased L Screens for the batting cages directly from a vendor.
