STRATEGIC PLAN:

4.2 High Quality Urban Approach: Continue to support high-quality planning, ranging from building design to neighborhood layouts, while pursuing urban approaches to issues such as multimodal transportation, infill, density, connected trails and parks, and walkable neighborhoods.

BACKGROUND:

On April 16, 2024, the Bozeman City Commission conducted their review of the Preliminary Plat application for the Urban + Farm Phase 2 Subdivision, application 23039, and voted unanimously to approve the preliminary plat application and associated variance. The Findings of Fact and Order for the preliminary plat was signed by the mayor on May 14, 2024 and may be found in the Public Folder for project 23039 detailing the meeting proceedings. An application was submitted to the City of Bozeman Department of Community Development for Final Plat review for the Urban + Farm Phase 2 Subdivision under application number 25128 to subdivide 2 lots zoned REMU and B-2M totaling 86.44 acres into a 39 lot major subdivision for residential, commercial, park, and open space uses.

The County Treasurer has certified that all real property taxes and special assessments assessed and levied on the land to subdivide have been paid.

Following City Commission approval of the preliminary plat application the following infrastructure improvements have been completed and accepted by the Engineering Division and are listed on the face of the plat:

  • Hardscape, equipment, landscaping and trails within all parks, excluding grass seeding and sod.
  • All streets, utilities, curb, gutter, and stormwater facilities, excluding Huffine intersections and approaches for South Eldorado Avenue, South Laurel Parkway, Pond Lily Drive, Water Lily Drive, Betty Lane, Competition Drive, and Valley Commons Drive.
  • All public right-of-way sidewalks, pedestrian ramps, and street lighting including the Huffine Asphalt path east to South Cottonwood Road
  • Sidewalks, gravel, boardwalks, bridges and asphalt paths in Open Spaces.
  • All non-grass landscaping including trees along arterials and collector streets, and within open spaces.
  • Five irrigation wells and meter pits for irrigation from municipal water supplies.

An Improvements Agreement is required for final plat approval of this subdivision to financially guarantee remaining infrastructure:

  • ROADWAY INFRASTRUCTURE IMPROVEMENTS

    • Laurel Parkway and Huffine Lane intersection signal
    • Approaches to Huffine Lane for Laurel Parkway, Water Lily Drive, and Betty Lane including finish gravel, curb & gutter, asphalt, pavement markings and striping
    • Remaining Norton Ranch Lift Station (NRLS) improvements including landscaping, striping, and asphalt patching
    • Sidewalks/concrete pathways within mid-block pedestrian easements within Blocks 3, 6, 7, and 8
    • Remaining power/lighting in Open Space H
  • LANDSCAPING & IRRIGATION IMPROVEMENTS

    • All rights-of-way seeding including boulevards fronting parks and open spaces
    • Remaining seeding and sod within Parks A, B, C, D, E, F and G
    • Remaining seeding and sod within Open Spaces A, C, D, E, F, G, H, I, J, K and Block 11 easement
    • Laurel Parkway median landscaping
    • Watercourse setback landscaping Open spaces D and E
    • Stormwater pond landscaping Lot 2, Block 11
    • Seeding from the east property line to Cottonwood Road along the shared use path
    • Landscaping within mid-block pedestrian easements within Blocks 3, 6, 7, and 8
    • All remaining irrigation components for Open Spaces A-K and Parks A-G
    • Irrigation components for mid-block pedestrian easements within Blocks 3, 6, 7, and 8

Due to the critical nature of the approaches to Huffine Lane and the intersection signal for the Laurel Parkway and Huffine Lane intersection a Notice of Building Permit Restriction will be recorded with the plat limiting the issuance of building permits until the intersections are completed and accepted by the Engineering Division. At which time, the building permit restriction may be released.

Development Review Committee staff has concluded that all terms and conditions of the preliminary plat approval have been met, and a digital copy of the final plat is attached. The original, signed mylars and the document attachments are on file with the Department of Community Development pending approval by the City Commission.
