Proposed Ordinance No. 26-026- Second Reading, An Ordinance of the City Commission of the City of Boynton Beach, Florida, approving the abandonment of a portion of a 20-foot alley, within Block 5, lying between Lot 22 and Lots 23-25, inclusive, Lake Addition to Boynton; authorizing the City Manager to execute a disclaimer, which shall be recorded with this ordinance in the public records of Palm Beach County, Florida; providing an effective date; and for all other purposes.

The applicant, Dr. Wilkens Mondesir, the owner of the property located at 812 N. Federal Highway, is requesting the partial abandonment (ABAN-2026.02.0735) of the 20-foot alley, within Block 5, lying between Lot 22 and Lots 23-25, inclusive, Lake Addition to Boynton. The abandonment area is outlined below (refer to Exhibit A – Proposed Abandonment):
The applicant is requesting to abandon that portion of the 20-foot alley, within Block 5, lying between Lot 22 and Lots 23-25, inclusive. This portion of the right-of-way does not provide access to neighboring properties. The abandoned land will be transferred to the abutting property owner(s) as an equal split as per state statute. There are some existing utilities within this right-of-way, however both adjacent property owners have provided assurance that easements will be provided to each utility company as needed.
The subject area is approximately 2,852 square feet (0.065 acres) and 20 feet wide (Exhibit B – Legal Description).
The applicant has provided a justification statement for the abandonment request (see Exhibit D – Justification Statement).

The abandonment will reduce the right-of-way that needs to be maintained by the City, and will increase property tax revenue as the abandoned right-of-way will become a part of the adjacent private properties.
