Proposed Resolution No. R26-171- Approve the conveyance of four (4) City-owned parcels in the Arden Park Addition and Robert Wells' Subdivision to the Boynton Beach Community Redevelopment Agency by Quitclaim Deed, declare the parcels surplus, and authorize the Mayor to execute the deed.

Requested Action:  

Staff recommends approval of Proposed Resolution No. R26-171.


Explanation of Request:  

The City owns four contiguous parcels in the Heart of Boynton District along the Martin Luther King, Jr. Boulevard corridor. All four were originally conveyed to the City by the CRA for community redevelopment purposes, and none are currently in active use or needed for City purposes.

 

Parcels 1 and 2 (PCNs 08-43-45-21-18-000-1510 and -1540) — Lot 151 and Lots 154, 155, and 156, Arden Park Addition to Boynton (PB 2, PG 96), less the portions dedicated in OR BK 32295, PG 1417, together with those portions of vacated Australian Boulevard (NE 3rd Street) and the vacated alleyway acquired under City Ordinance Nos. 19-029 and 18-027. These parcels were conveyed by the CRA to the City by Quit Claim Deed recorded September 15, 2021 (OR BK 32935, PG 809), then conveyed by the City to Lutheran Services Florida, Inc. in January 2022 (OR BK 33387, PG 678) for a planned daycare facility. Lutheran Services Florida was unable to perform on the intended project and reconveyed both parcels to the City by Warranty Deed recorded January 11, 2024 (OR BK 34847, PG 671). They have been held by the City without an active redevelopment use since.

 

Parcels 3 and 4 (PCNs 08-43-45-21-04-000-0050 and 08-43-45-21-18-000-1572) — Lot 5 of Robert Wells' Subdivision (PB 11, PG 66) together with a portion of Lots 157, 158, and 159, Arden Park Addition to Boynton (PB 2, PG 96), containing 0.210 acres more or less and fronting Martin Luther King, Jr. Boulevard. These two parcel control numbers share a single legal description and were conveyed by the CRA to the City by a Quitclaim Deed recorded on November 7, 2019 (OR BK 31013, PG 899). They have remained in City ownership without a redevelopment use since that date.

 

The CRA is the agency charged with implementing the Boynton Beach Community Redevelopment Plan in the Heart of Boynton District and holds the acquisition, disposition, and funding authority to assemble these parcels and solicit a qualified redevelopment partner for the MLK Jr. Boulevard corridor. Conveying both parcels in a single instrument returns the assemblage to the entity best positioned to place it back in productive, tax-generating use consistent with the adopted Plan.

 

Because the Property lies within the Community Redevelopment Area, was acquired by the City for community redevelopment purposes, and is no longer needed for City purposes, the disposition procedures in Section 2-56(c) of the City Code do not apply, pursuant to Section 2-56(d). Consideration is Ten Dollars ($10.00) and other good and valuable consideration.

How will this affect city programs or services?  

Supports economic development and neighborhood revitalization by returning underutilized City-owned land in the Heart of Boynton to the redevelopment agency for productive reuse along the MLK Jr. Boulevard corridor.

Fiscal Impact:  

No fiscal impact to the City's operating budget. Recording costs and documentary stamps are de minimis and will be borne by the CRA. Removing the parcel from the City's inventory eliminates ongoing maintenance and liability carrying costs.
