Proposed Ordinance No. 26-027- First Reading, an Ordinance of the City Commission of the City of Boynton Beach, Florida, Amending Part III "Land Development Regulations," Chapter 1 "General Administration," Article II "Definitions" to add a definition for "Charitable Institution"; Amending Chapter 2 "Land Development Process," Article II "Planning and Zoning Division Services," Section 4 "Relief Applications" to add a waiver for the Art in Public Places (AIPP) program for Charitable Institutions; and Amending Chapter 4 "Site Development Standards," Article XIV "Art in Public Places and Public Beautification," Section 2 "Art in Public Places Program" to provide a forty percent (40%) reduction of the required public art budget for qualifying charitable institutions; providing for codification; providing for severability; providing for conflicts; and providing for an effective date.

Staff recommends approval of Proposed Ordinance No. 26-027 First Reading.


Explanation of Request:  

Staff is proposing to amend the City Land Development Regulations (LDRs) Part III, Chapter 4, Article XIV, Sec. 2, Art in Public Places Program, to incorporate a Commission-approved Art in Public Places (AIPP) Charitable Institution Waiver for 501(c)(3) non-profit organizations that meet the proposed waiver criteria to be amended within Chapter 2, Article II, Sec. 4, Relief Applications, and incorporate the definition for Charitable Institution into Chapter 1, Article II, Definitions.

 

This waiver will grant a forty percent (40%) reduction to the project’s total required Public Art Budget (1% of the project’s total construction value). Staff’s intent is to provide relief to registered 501(c)(3) charitable institutions that receive a construction valuation of $500,000.00 or over and meet the proposed required criteria, which would otherwise mandate full participation in the Art in Public Places (AIPP) program.
