Proposed Resolution No. R26-168- Approve Amendment One (1) to an existing Landscape Maintenance Memorandum of Agreement ("MMOA") between the City of Boynton Beach and the State of Florida Department of Transportation ("FDOT") for landscape, irrigation, and decorative hardscape within the FDOT Right-of-Way along North Federal Highway abutting The Pierce project.


Proposed Resolution No. R26-169- Approve a Right-of-Way Maintenance Agreement between the City and BB QOZ, LLC for landscape, irrigation, and decorative hardscape within the FDOT Right-of-Way along North Federal Highway abutting The Pierce project.

Requested Action:  

Staff recommends approval of Proposed Resolution No. R26-XXX and Proposed Resolution No. R26-XXX.


Explanation of Request:  

The Pierce project, located along North Federal Highway, proposes to install and maintain landscape, irrigation, and decorative hardscape within the FDOT right-of-way along North Federal Highway at the sole cost and expense of the property owner. FDOT will not contract with a private owner/developer for said non-standard improvements, requiring the City to enter into a Maintenance Memorandum of Agreement (MMOA) with FDOT.  This agenda item also requires the developer to enter into a Right-of-Way Maintenance Agreement with the City to transfer the City’s maintenance obligations under the FDOT MMOA to the owner of The Pierce project.
