Proposed Resolution No. R26-189- Authorizing the acceptance of ownership of two (2) solar canopy structures at Oceanfront Park from Florida Power & Light Company through a Quit Claim Bill of Sale; authorizing the Mayor to execute the Quit Claim Bill of Sale and any related documents.
Staff recommends approval of Proposed Resolution No. R26-189.
Florida Power & Light Company (FPL) installed solar canopy structures at Barrier Free Park and Oceanfront Park under the FPL SolarNow program, by a Solar Lease and Easement Agreement approved by Resolution No. R17-006 on January 17, 2017, and amended by a Second Amendment approved by Resolution No. R18-142 on October 2, 2018.
At its March 23, 2026 meeting, the City Commission adopted Resolution No. R26-045. That resolution approved the termination of the Solar Lease and Easement Agreement and accepted ownership of the solar canopy system at Barrier Free Park. The Quit Claim Bill of Sale for Barrier Free Park was approved and executed at that meeting. A Quit Claim Bill of Sale for the Oceanfront Park structures was not included at that time.
FPL has agreed to transfer the two (2) aluminum solar canopy structures at Oceanfront Park, 6415 N. Ocean Boulevard, to the City by a separate Quit Claim Bill of Sale. The structures will be transferred in a depowered condition, together with their foundations and structural components. All electrical equipment, wiring, inverters and related electrical components are excluded. The City will accept the structures "as is, where is," without warranty.
Approving this item completes the transfer of the FPL SolarNow canopy structures to the City. It also authorizes the Mayor to execute the Quit Claim Bill of Sale and any related documents.
The City will keep the canopy structures at Oceanfront Park as shade structures for park visitors. Because the electrical components are excluded, the structures will not generate electricity. The City will be responsible for maintaining the structures from now on.
Future maintenance will be absorbed in the Recreation & Parks / Public Works operating budgets.
The consideration is a nominal $10.00.
