Proposed Ordinance No. 26-028- First Reading, an ordinance of the City Commission of the City of Boynton Beach, Florida, amending Part III, Chapter 1, Article II, "Definitions," to create a Personal Instruction and Consultation Services use classification; and amending Chapter 3, Article IV, "Use Regulations," to amend the Use Matrix and Use Footnotes to establish the zoning districts in which the use is permitted or conditional; providing for codification; providing for severability; providing for conflicts; and providing for an effective date.

Requested Action:

Staff recommends approval of Proposed Ordinance 26-028 at first reading.

Explanation of Request:

Staff requests approval of amendments to the Land Development Regulations to create a new use classification, Personal Instruction and Consultation Services, and to establish the zoning districts in which the use is permitted or conditional. The amendment adds a definition of the classification in Part III, Chapter 1, Article II, Definitions, and updates the Use Matrix and use footnotes in Part III, Chapter 3, Article IV, Section 3.D and Section 3.E, including new Footnote 108, which applies size, location, and operational standards to the classification.

The new classification groups a range of appointment or walk-in consultation services, including personal and life coaching, etiquette and image consulting, matchmaking services, genealogy services, and astrology, palm reading, psychic reading, and fortune telling. The Fortune Teller, Palm Reader, or Psychic use is currently permitted only in the M-1 (Industrial) district. The amendment consolidates that use into the new classification and allows it, on the same terms as comparable consultation services, in additional commercial and mixed-use districts, subject to the standards in Footnote 108.

As set forth in the Use Matrix, the classification is Permitted in the C-2, C-3, and C-4 districts, the SMU, MU-1, MU-2, and MU-3 districts, and the M-1 district, and Conditional in the CBD, MU-4, and MU-C districts. The item is scheduled for two advertised public hearings before the City Commission, on October 6, 2026 and October 20, 2026.
