Approval of an Interlocal Agreement between the City and the Boynton Beach Community Redevelopment Agency for funding the removal of the historic Oyer mural, and authorization to negotiate and execute all agreements and documents necessary to remove the mural, transfer it to the City, and store it.
City Commission Motion
Motion to approve the Interlocal Agreement between the City and the Boynton Beach Community Redevelopment Agency for funding of the removal of the historic Oyer mural, in substantially the form presented. The motion also directs the City Manager to negotiate, and authorizes the Mayor to execute, all agreements, consents, releases, conveyances, and related documents with Verdex Construction, BB QOZ, LLC, 500 Ocean Properties, LLC, the Oyer family, and any other necessary party, as needed to implement the removal, transfer to the City, and storage of the mural, subject to approval by the City Attorney as to form and legal sufficiency. This is provided that:
1. The cost of removal paid by the City does not exceed the CRA funding approved under the Interlocal Agreement;
2. The City bears no cost other than storage; and
3. No agreement obligates the City to install, display, restore, or maintain the mural.
If these conditions cannot be met, the item will be brought back to the City Commission and the CRA Board.
CRA Board Motion
Motion to approve the Interlocal Agreement between the Boynton Beach Community Redevelopment Agency and the City for funding of the removal of the historic Oyer mural, in an amount not to exceed $100,000, in substantially the form presented. The motion also authorizes the Executive Director to negotiate and finalize the agreement and to take any action necessary to implement the Board’s direction, subject to approval by CRA legal counsel as to form and legal sufficiency, and authorizes the Board Chair to execute the final agreement and any related documents. Any funding above $100,000 will require further Board approval.
At the joint meeting on October 6, 2026, the City Commission and the CRA Board directed staff to proceed with removal of the historic Oyer mural from the east wall of 529/531 East Ocean Avenue before the building is demolished for The Pierce.
Under Section 21 of the CRA’s 2021 purchase agreement with 500 Ocean Properties, LLC, as assumed by BB QOZ, LLC, the property owner’s obligation is limited to best efforts up to $20,000. Neither the City nor the CRA has a contractual obligation to fund the removal.
BB QOZ, LLC has advised that it will contract with Verdex Construction to demolish the building, and that its contract will authorize Verdex to remove and relocate portions of the building, including the mural. BB QOZ has indicated it will contribute $20,000 toward the removal but will not otherwise perform or fund the work. Verdex has offered to perform the removal. The estimated removal cost is $132,000.
Under the proposed Interlocal Agreement, the CRA will fund removal in an amount not to exceed $100,000. Any amount above that requires further approval by the CRA Board. The City will take title to the mural and store it at a City-owned facility at its own cost. The City makes no commitment to future installation, which would be subject to separate approval and appropriation.
The final arrangements with BB QOZ, Verdex, and the Oyer family are still being finalized. They are expected to include an agreement between the City and Verdex for the removal and a consent, waiver, and release from the Oyer family. Staff therefore requests authority to negotiate and execute the agreements and documents necessary to complete the removal, transfer, and storage of the mural, within the parameters stated in the motion. If removal cannot be accomplished within those parameters, staff will return to the City Commission and the CRA Board.
There will be no impact to City programs or services.
