Proposed Resolution No. R26-191- A Resolution of the City Commission of the City of Boynton Beach, Florida, approving a Piggyback Agreement between the City and T-Mobile USA, Inc. for Mobile Communication Services (including cellular voice and data services, devices, accessories, and related telecommunications services), utilizing the State of Florida Department of Management Services Contract No. DMS-19/20-006B, which was competitively procured by the State through an Invitation to Negotiate and renewed through August 3, 2031; authorizing an annual expenditure in an amount not to exceed $20,000.00 with a total contract expenditure in an amount not to exceed $100,000.00; for a term commencing upon full execution by both parties and continuing through August 3, 2031, subject to the continued validity or extension of the underlying State contract; and providing an effective date.

Requested Action:

Staff recommends approval of the proposed Resolution No. R26-191.

Explanation of Request:

The police department is requesting approval to enter into a Piggyback Agreement with T-Mobile USA, Inc. for mobile communication services utilizing State of Florida Department of Management Services Contract No. DMS-19/20-006B.

The State of Florida competitively procured the underlying contract through an Invitation to Negotiate for Mobile Communication Services, including cellular voice and data services, cellular data-only services, telecommunications services, cellular phones, associated devices, accessories, and related features.

The proposed agreement will allow City departments to purchase T-Mobile cellular voice and data services, devices, and other related telecommunications services under the pricing, terms, and conditions established by the State of Florida master agreement.

The original State contract was established between the Florida Department of Management Services and T-Mobile USA, Inc. under Contract No. DMS-19/20-006B. The State subsequently exercised a five-year renewal extending the master agreement from August 4, 2026 through August 3, 2031.

The City's Piggyback Agreement will commence upon full execution by both parties and remain in effect through August 3, 2031, subject to the continued validity or extension of the underlying State contract.

How will this affect city programs or services?

Approval of the agreement will provide City departments with an established contractual vehicle for acquiring cellular voice and data services, mobile devices, accessories, and related telecommunications services from T-Mobile.

The agreement provides the City with access to the pricing and service structure established under the State of Florida's competitively procured master agreement while avoiding the need for a separate City solicitation for substantially the same services. The contract also provides access to services intended to support both general government and public safety mobile communications needs.

Approval will provide an additional telecommunications service option that can be utilized where operational requirements, network coverage, service resiliency, or departmental needs make T-Mobile an appropriate provider.

Budgeted Item:  Yes
Account Line Item and Description:

Actual expenditures will be based on services and equipment ordered by City departments and will be charged to the applicable departmental operating budgets.

Fiscal Impact:

The agreement establishes an annual not-to-exceed amount of $20,000.00 for mobile communication services, devices, and related telecommunications services purchased from T-Mobile USA, Inc.

The maximum potential expenditure is $20,000 per fiscal year, subject to annual budget appropriation. The agreement remains in effect through August 3, 2031, unless terminated earlier or affected by expiration or termination of the underlying State of Florida master agreement.
