MINOR FINAL PLAT FOR A BOUNDARY LINE ADJUSTMENT CREATING THREE OUTLOTS AT 5500 GEORGE WASHINGTON CARVER AVENUE
574 Investments, LLC and Hunziker Development Group, LLC are requesting approval of a Minor Subdivision Final Plat in order to address the rezoning request for the first phase of the planned Greenbriar Subdivision. The site is currently four quarter-quarter sections of land addressed as 5500 George Washington Carver Avenue. The Final Plat will result in three lots that will match planned phases of their development (See Attachment A Location map).
The owner requests to adjust boundary lines of the existing quarter-quarter sections of land to create three outlots: 1) Outlot XX (74.14 acres), 2) Outlot YY (28.88 acres), and 3) Outlot ZZ (49.19 acres) (See Attachment B- Minor Final Plat). Outlot ZZ and Outlot YY are related to the rezoning of part of the site to FS-RL with a Master Plan.
Although the City classifies the proposal as boundary line adjustment because there are fewer parcels than current exist, under state law the creation of the outlots in this case requires a Minor Subdivision Final Plat in lieu of a Plat of Survey as it will constitute the third division of some of the properties.
The property is currently undeveloped and rowcropped as Agricultural Land. The property was annexed into the City last year. The owner has future plans to further subdivide the property into the Greenbriar Subdivision Masterplan area.
The three outlots require no public improvements because of the boundary line classification. Therefore, the creation of the outlots can be approved as a Minor Subdivision without first having a Preliminary Plat approval. No development of the outlots can occur without future approval of a preliminary plat and final plat.
- Approve the Minor Final Plat for Greenbriar Subdivision.
- Deny the Minor Final Plat for Greenbriar Subdivision on the basis that the City Council finds that the development does not comply with the Zoning or the Subdivision Ordinance, creates a burden on existing public improvements, or creates a need for new public improvements that have not yet been installed.
- Refer this request back to staff or the applicant for additional information.
After reviewing the proposed minor final plat for Greenbriar Subdivision, staff finds that it complies with all relevant and applicable design and improvement standards of the Subdivision Regulations of the Municipal Code, Ames Plan 2040, and other adopted City plans, ordinances, and standards.
The creation of three proposed outlots will create boundary lines to facilitate future subdivision and development of the Greenbriar Master Plan area. Approval of this Plat will fulfill one of the conditions related to the rezoning request to establish a lot that matches the area of the rezoning. Therefore, it is the recommendation of the City Manager that the City Council approve Alternative #1, as described above.
