Approve a Resolution determining the Industrial Disability Retirement of Fire Chief Geoffrey Belyea, a District Safety employee covered by contract with the California Public Employees Retirement System.

The American Canyon Fire Protection District (“District”) is a contracting agency with the California Public Employees’ Retirement System (“CalPERS”) for certain District employees, including Firefighter Geoffrey Belyea, who applied for a disability retirement on July 30, 2026.
Government Code section 21156 (a)(2) requires that the governing body of a CalPERS contracting agency, such as the District, certify to CalPERS whether a safety member who applies for Industrial Disability Retirement is incapacitated for the performance of his or her usual and customary duties.
An evaluation has been presented in Closed Session based on the review of relevant evidence as to whether the District Board can determine that Fire Chief Geoffrey Belyea is incapacitated within the meaning of the Public Employees’ Retirement Law for the performance of his duties in the position of Fire Chief. The Board's determination must be based upon competent medical opinion and other relevant evidence as required by Government Code section 21156.
Consistent with Government Code section 21156 (a) (2) and applicable law, the District Board should also determine whether any incapacity is a result of injury or disease arising out of, and in the course of, his employment as a local safety member.
The District will provide Advance Disability Pension Payments (ADPP) while Mr. Belyea’s Industrial Disability Retirement application is being processed by CalPERS. If the application is approved, reimbursement of eligible ADPP payments will be administered in accordance with applicable CalPERS procedures.
